By completing your purchase of "The F.A.S.T. Way: video course and / or live coaching products, you, ("PARTICIPANT"), acknowledge and agree to the the following terms and conditions set forth herein:
Article 1: Nature of Relationship
1.1. Breakthrough Leadership Training (a division of division of Fire Breathing Dragon, Inc.) ("CONSULTANT") will provide Consulting Services via a pre-recorded video course and/or live coaching calls according to the prescribed program of the course.
1.2. The Participant understands that the Consulting relationship is not psychotherapy, psychological counseling, or any type of therapy; nor is it a substitute for these services. In the event the Consultant or Participant feel the need for the Participant to receive professional counseling or therapy, it is the responsibility of the Participant to seek a licensed professional who can provide these services.
Article 2: Session Length
2.1. Live Coaching calls are 60 minutes in length. The Participant can join at any time, though the session will not be extended to account for the Participant joining later than the schedule start time of the call.
2.2. Sessions are generally scheduled for Thursdays at 9 a.m. Pacific Time, though may on occasion be rescheduled or cancelled out of necessity. There will be no session when a nationally recognized major holiday falls on a Thursday. There will be no Session during on the last two Thursdays of December.
2.3. There are no make-ups for missed sessions.
Article 3: Session Procedures
3.1. All sessions will be scheduled via an accepted Virtual Meeting Platform, currently intended to be Zoom, though the platform could change if the Consultant determines that another platform can better serve Participants’ needs and the delivery of the course.
3.2. The Participant agrees to download and be prepared to sign in with the designated platform prior to scheduled sessions.
3.3. The Consultant agrees to be on time for all sessions. If the Consultant is late, the session time WILL BE EXTENDED to the full 60 minute session time.
Article 4: Course Membership Area/Session Recordings
4.1. Participant acknowledges that sessions held in Virtual Meeting Format (i.e. Zoom) will be recorded for the purpose of i) posting the recording to the Course Membership Area for the personal use and reference of all Course Participants and ii) Consultant’s internal use to better serve Participants in future sessions, refining Consultant’s methods and services, and company training purposes.
4.2. Participant agrees not to distribute or retransmit session recordings outside of the Course Membership Area at any time, in any way or to any person.
4.3. Participant acknowledges that Consultant may re-post, retransmit and/or sell Session recordings or portions thereof for other membership purposes or on other platforms such as Social Media.
4.4. Consultant will provide to Participant the necessary login credentials to access the Course Membership Area, where session recordings, workbooks and other course materials will be made available.
Article 5: Termination
5.1. The Consultant MAY terminate a Participant’s participation in live coaching calls at will and at consultant's discretion, provided consultant refund any pro-rated, unused potion of participant's monthly or annual live coaching subscription.
5.2. A Participant MAY terminate his/her own participation in the course at will, though there will NO REFUNDS of any unused portion of participant's subscription.
Article 6: Confidentiality
6.1. This Agreement in no way implies or intends to be constrained by the “confidentiality” governed by law in other professional relationships such as with a lawyer, doctor or licensed therapist, and there are situations in which the Consultant is obligated to breach the Participant’s confidentiality to protect others from harm, including if i) the Consultant has information that indicates a child, or elderly or disabled person is being abused; the Consultant must report this information to the appropriate agency, and ii) if the Participant is an imminent risk to him/herself or makes threats of imminent violence against another person; or iii) the Consultant is required to take protective actions.
These situations rarely occur in Consulting practices, but if such a situation does occur, the Consultant will make every effort to discuss with the Participant before taking any action.
6.2. Participant acknowledges that live coaching calls constitute a "group" course and waive all rights of privacy or confidentiality for information that participant voluntarily discloses during group coaching calls.
Article 7: Indemnification
7.1. The Participant agrees to indemnify and hold the Consultant harmless from and against any and all liability, claims, losses, damages, and expenses which the Participant may suffer or incur as a result, directly or indirectly, of the Participant’s participation in the course or any activity undertaken by the Participant pursuant to the services provided to the Participant by the Consultant. This indemnification shall survive any termination or expiry of this Agreement.
Article 8: Nondisclosure
8.1. The Participant recognizes that much of the content, methods, materials, frameworks, formulas and practices of the courses provided by the Consultant are proprietary, copyrighted and/or trademarked Intellectual Property belonging in whole or in part to Ken Golde and Breakthrough Leadership Training, a division of Fire Breathing Dragon, Inc., and agrees not to sell, retransmit, post online or otherwise distribute or exploit the course content or materials, including handouts, workbooks and presentations decks, without the express, written permission of the Consultant.
8.4. The Participant also agrees not to provide or disclose any Virtual Meeting links, login credentials to the Membership Area or passwords for access to the course or Consulting materials to anyone not enrolled in this course.
The Participant agrees to the foregoing by submitting his/her order to purchase the video and/or live coaching courses.
